1. Who we are
Fablekeep is operated by David Bolívar Saldarriaga, Colombia. In these terms, “Fablekeep”, “we” and “us” mean the operator. You can reach us at support@fablekeepvtt.com for legal, privacy and copyright matters, at support@fablekeepvtt.com for help with the product, and at support@fablekeepvtt.com for anything else.
2. What these terms cover
These terms apply to:
- the website at fablekeepvtt.com and its pages;
- the online demo of Fablekeep, if and while we offer one;
- any online service that Fablekeep runs itself, now or later — for example a hosted tier, a relay that connects players, or a marketplace (together, our “Hosted Services”).
The Fablekeep software you install is licensed under the End-User Licence Agreement (EULA). Payments are handled by Creem under its own buyer terms (see Refunds). If these terms and the EULA disagree about the software, the EULA wins.
3. Age
You must be at least 13 years old to use the website and the Hosted Services, or 16 if you live in the European Union or the European Economic Area (or the higher minimum age that applies where you live). If you are under the age of majority where you live, a parent or guardian should agree to these terms and to any purchase for you.
4. Using our services fairly
When you use the website or the Hosted Services, please do not:
- break the law, or help someone else break it;
- upload, share or distribute content that infringes someone else’s copyright, trademark or other rights (see section 5);
- attack, overload, probe or try to break into our systems, or get around limits or security measures;
- harass other people, or share content that is unlawful, sexually explicit or sexually suggestive, sexualises minors, or promotes violence against people (the full rules are in our Acceptable Use Policy);
- resell or rent access to the Hosted Services without our written permission.
The demo is for trying Fablekeep. Its worlds, maps and art are ours or our licensors’, and are provided only for that purpose.
5. Your content and copyright
Fablekeep is a tool for your own campaigns. We respect creators — the artists, cartographers, musicians and writers whose work makes tabletop games better — and we do not support copyright infringement.
5.1 Your content stays yours, and so does the responsibility
Anything you create or bring into Fablekeep — maps, tokens, music and sound, asset packs, handouts, compendium data and text — is your content. You keep your rights in it. You are responsible for it, and by importing it you confirm that you own it or have the rights or permission needed to use it the way you use it.
5.2 No redistribution of other people’s work
Paid and licensed assets (for example map packs and token packs you bought) usually allow personal use only. You must not use Fablekeep to redistribute them: not in exported or shared worlds and modules, and not through a server you host for others. To help, Fablekeep marks imported asset packs as not redistributable by default; exports meant for sharing leave them out unless you switch on “licence allows redistribution” for a pack — and you should do that only when the pack’s licence really allows it.
5.3 The optional AI assistant
Fablekeep has two optional AI features, both off by default: an assistant that uses your own account with an AI provider (for example Anthropic’s Claude, connected through MCP) to help you prepare and run your campaigns with your own material — your worlds, your notes and the assets you own; and AI text helpers that suggest NPC names and draft session recaps, using your own API key with a provider you choose (an OpenAI-compatible service or Anthropic) or a local model. Their use is governed by that provider’s terms. Neither generates images or art, and nothing they produce is presented as art. We make no promise that text they draft is original, accurate or protected by copyright, or that you may use it for any particular purpose. Do not use them to produce content that infringes others’ rights — for example copies of protected characters or other people’s writing. You must not use them to create sexually explicit, pornographic, sexually suggestive or other adult (NSFW) content of any kind, and never content that sexualises minors, whatever your provider’s own terms allow (see the Acceptable Use Policy). You are responsible for what you produce with them and how you use it.
5.4 Importing characters from D&D Beyond
Fablekeep can import character sheets you export from D&D Beyond, and, where you enable it, characters you have made public there. This is only for your personal use of content you own or are entitled to use. Before link import is enabled on a self-hosted server, Fablekeep asks the server owner to confirm this in the app. Imported text that is not part of the SRD 5.2 stays in your own worlds and is never included in shared exports. Servers run by Fablekeep never fetch content from D&D Beyond on your behalf. D&D Beyond is a trademark of its owner; Fablekeep is not affiliated with or endorsed by it (see section 8).
5.5 We don’t look at your files
Your worlds and files live on your own computer or on the server you choose. We do not monitor, scan or index them, and the app does not send them to us. We act on content only when it is on a service we run and we receive a valid notice (section 6) or otherwise become aware of a clear violation.
5.6 Content on our Hosted Services
When you put content on a Hosted Service, you give us a limited licence to store, copy and display it only as needed to run that service for you and the people you invite. This licence ends when you delete the content or your account, except for backups that expire on their normal schedule.
6. Copyright notices and counter-notices
If you believe content on a service we run infringes your copyright, send a notice to support@fablekeepvtt.com with:
- your name and contact details, and your signature (typed is fine);
- the work you believe is infringed;
- where the content is (a link or other precise location) so we can find it;
- a statement that you believe in good faith that the use is not authorised by the owner, its agent or the law;
- a statement that the information in your notice is accurate and that you are the owner or authorised to act for them.
We will review valid notices promptly and may remove or disable the content, and we will tell the person who posted it where we can.
Counter-notice. If your content was removed and you believe it was a mistake or that you have the right to use it, write to support@fablekeepvtt.com with your contact details, the content removed and where it was, a statement in good faith that it was removed by mistake or misidentification, and your consent to the jurisdiction of the courts of your place of residence (or of Colombia, if you live outside the countries where such consent is meaningful). We will forward it to the person who sent the original notice and may restore the content unless they tell us they have started legal action.
Repeat infringers. On Hosted Services we will close the accounts of users who repeatedly infringe others’ rights, in appropriate circumstances.
Notices only concern services we run. For content on a server run by someone else, contact that server’s operator.
7. Suspension and termination
We may suspend or end your access to a Hosted Service, or revoke a licence key, only for a material breach — namely:
- piracy or cracking of Fablekeep, or helping others do it;
- sharing, publishing or reselling licence keys;
- refund or chargeback fraud;
- using a service we run (a hosted tier, the online demo, or a future relay or marketplace) to distribute infringing content;
- using a service we run to create or share content our Acceptable Use Policy prohibits.
Where possible and lawful we will tell you first, explain why, and give you a chance to fix the problem. Ordinary mistakes and disagreements are not material breaches. We will never delete the worlds stored on your own computer.
8. Trademarks and the 5e rules
Fablekeep is compatible with the 5e 2024 rules (SRD 5.2) and includes material from the SRD 5.2 under the Creative Commons Attribution 4.0 licence:
This work includes material from the System Reference Document 5.2 (“SRD 5.2”) by Wizards of the Coast LLC, available at https://www.dndbeyond.com/srd. The SRD 5.2 is licensed under the Creative Commons Attribution 4.0 International License, available at https://creativecommons.org/licenses/by/4.0/legalcode.
Fablekeep is an independent product and is not affiliated with or endorsed by Wizards of the Coast. D&D Beyond and other names mentioned are trademarks of their respective owners and are used only to describe compatibility. Claude and Anthropic are trademarks of Anthropic, PBC, and OpenAI is a trademark of OpenAI: Fablekeep is not affiliated with or endorsed by Anthropic, OpenAI or any other AI provider; its optional assistant is an integration that works with your own account. The Fablekeep name and logo belong to the operator named in section 1. See Licences for all third-party credits.
9. No warranty
The website, the demo and the Hosted Services are provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do our best to keep things running, but we do not promise that any service will be uninterrupted, error-free or kept forever. This does not limit rights you have as a consumer that cannot be excluded by contract.
10. Limitation of liability
To the extent the law allows, our total liability to you for any claim related to these terms or our services is limited to the amount you paid us for Fablekeep (or, if you paid nothing, USD 50). We are not liable for indirect or consequential losses, such as lost profits, lost data you could have backed up, or lost goodwill.
Nothing in these terms limits liability for fraud, for death or personal injury caused by negligence, for gross negligence or wilful misconduct, or any other liability that cannot be limited by law.
11. Governing law and disputes
These terms are governed by the laws of Colombia. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live (for example in the European Union), and you may bring a claim in the courts where you live where that law allows. Before going to court, please write to support@fablekeepvtt.com: most problems can be solved by talking.
EU consumers can also use the EU’s online dispute resolution information at consumer-redress.ec.europa.eu. Colombian consumers can contact the Superintendencia de Industria y Comercio.
12. Changes to these terms
We may update these terms when the product or the law changes. We will post the new version here with a new date and, for material changes, give notice on the website or in the app at least 30 days before they take effect. Changes never apply retroactively to a purchase you have already made.
13. General
If a court finds part of these terms invalid, the rest stays in effect, and the invalid part is replaced by the valid term closest to its intent. If we do not enforce a term right away, we have not waived it. These terms, the EULA and the policies they link to are the whole agreement between us about the website and the Hosted Services. We may transfer these terms to a successor (for example a company set up to run Fablekeep); your rights will not be reduced by such a transfer. Where a translation differs, the English version controls to the extent the law allows.
